Terms and Conditions of Sale

This English translation is provided for information only. Only the French version of these Terms and Conditions is legally binding.
Article 1: Purpose
These general terms and conditions of sale govern sales of handmade textile accessories (skincare items, fashion, everyday accessories) concluded on the website www.letacreation.fr between L&A Création and any person acting as a consumer ("the customer"). Placing an order implies full acceptance of these Terms and Conditions, which the customer acknowledges having read before ordering.

Article 3: Products
The products offered are those described on the website on the day of the order. Each creation is handmade: slight variations (dimensions, shades, placement of patterns) may exist from one piece to another and are not a defect. Photographs are as accurate as possible but are not contractually binding.
Article 4: Prices
Prices are shown in euros, including all taxes, excluding delivery costs. Delivery costs are shown before the order is confirmed. L&A Création may change its prices at any time; products are invoiced at the price in force when the order is confirmed.
Article 5: Orders
The customer selects their items and options (colour, size, personalisation), confirms their cart, enters their delivery and billing details, chooses a delivery method and then pays. The order is final once payment has been made; a confirmation is sent by email.
Personalised or made-to-measure items are made according to the information provided by the customer (dimensions, first name, choice of fabrics…), who is responsible for its accuracy.
Article 6: Payment
Payment is made in full when ordering, by bank card, PayPal or Bancontact, via the secure payment platform Stripe. L&A Création never has access to the customer's bank details.
Article 7: Delivery
Products are delivered to the address given when ordering, using the chosen delivery method: Mondial Relay pick-up point, tracked La Poste delivery, or free collection from the workshop by appointment. Prices and the countries served are shown when ordering and on the page Shipping and guarantees.
As many items are made to order, the production and shipping time is shown on each product page; it is given for information only. In the event of a significant delay, the customer is informed by email.
The risk of loss or damage to the products passes to the customer when they take physical possession of them. If the parcel is damaged, the customer should record reservations with the carrier and contact L&A Création.
Article 8: Right of withdrawal
The customer has 14 days from receipt of their order to exercise their right of withdrawal, without giving any reason, by notifying L&A Création by email at l.acreation@yahoo.fr. Items must be returned in their original condition, unwashed and unused, no later than 14 days after this notification; return costs are borne by the customer. The refund is made within 14 days of the request, at the latest upon receipt of the items, using the same payment method as for the order.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to items personalised or made to measure according to the customer's specifications, nor, for hygiene reasons, to skincare items (pads, headbands, sponges…) that have been used.
Article 9: Guarantees
All products are covered by the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).
In addition, L&A Création offers a 6-month commercial guarantee from delivery against any manufacturing defect (excluding normal wear, misuse or unsuitable care). The item is then repaired free of charge in the workshop; a return slip is provided. To benefit from it, simply write to l.acreation@yahoo.fr.
Article 10: Intellectual property
All elements of the website (texts, photographs, creations, logos, graphic elements) are the exclusive property of L&A Création. Any reproduction or use, even partial, is prohibited without prior written consent.
Article 11: Personal data
The data collected when ordering is necessary to process and deliver the order. It is never sold or transferred. To find out more and exercise your rights, see our Privacy policy.
Article 12: Governing law and disputes
These Terms and Conditions are governed by French law. In case of difficulty, the customer should first contact L&A Création at l.acreation@yahoo.fr to find an amicable solution. Failing this, the dispute may be brought before the competent courts.
Article 13: Changes to these Terms
L&A Création may change these Terms and Conditions at any time. The applicable terms are those in force on the date of the order.
